- Could the model documents be revised?
Answer: Yes, the federal agencies that issued these notices could revise them at any time.
- Do employers have to use the exact language in the model notices?
Answer: No, in fact the agencies expect employers to revise them to accurately reflect specific information about the employer’s plans. However, using the models is typically considered to be a safe harbor – if a plan sponsor uses the model language (and fills in all additional information as indicated in the models) the content will be considered sufficient.
